Privacy and Transparency Policy of Kürbishof Koller

Kürbishof Koller takes the protection of your personal data very seriously. This Transparency Statement describes how we process your personal data and is directed at our existing and former customers, prospects and potential future customers as well as their respective shareholders, executive bodies and other employees.

Who are we?

Kürbishof Koller, Weinberg 78, 8350 Fehring, Österreich, Telefon +43 (0)3155 34 14 operates this website and is responsible for the content of this website.

Why do we process personal data?

We will process your personal data for the following purposes:

If we collect your personal data from you, the provision of your data is generally voluntary. However, if you do not provide us with your personal data, we may not (or not completely) fulfill our order.

What are the legal bases for processing?

If you are an interested party or a potential future customer, we will only process your contact data for the purpose of direct advertising via electronic mail or telephone contact with your consent in accordance with Art. 6 (1) a of the European General Data Protection Regulation (GDPR).

If you are our client, we process your personal data because this is necessary to fulfil the contract concluded with you. (Art. 6 par. 1 lit. b GDPR).

In all other respects, we process your personal data on the basis of our overriding legitimate interest in achieving the aforementioned purposes (Art. 6 par. 1 lit. f GDPR sowie Art. 9 par. 2 lit. g GDPR).

Do we guarantee adequate data security?

We maintain current technical measures to guarantee data security, in particular to protect your personal data from the dangers of data transfer and from third parties becoming aware of them. These are adapted to the current state of the art in each case.

Will data be passed on to other recipients? And: Are the data leaving the European Union or the European Economic Area?

To the extent that this is absolutely necessary for the aforementioned purposes, we will transfer your personal data to external service providers who will support us in the following activities:

We ensure that these service providers are carefully selected, contractually bound in accordance with data protection regulations and regularly checked. Among these service providers may also be companies that process your data outside the European Economic Area or have their registered office there. The level of data protection in other countries may not be the same as in Austria. We therefore take measures to ensure that all recipients offer an adequate level of data protection. For example, we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC). At these companies we only select companies that process the data in places for which there is a Commission adequacy decision (Article 45 GDPR). If this condition is not met, we only commission these service providers if they provide sufficient safety guarantees (Article 46 GDPR), for example by agreeing the EU standard contractual clauses.

How long does the data remain stored?

In principle, we store your personal data until the end of the business relationship in which we have collected your data or until the expiry of the applicable statutory limitation and retention periods; in addition, until the end of any legal disputes in which the data is required as evidence. If you are a customer, former customer, prospective customer or potentially future customer or a contact person of one of the aforementioned, we store your personal data for the purposes of marketing until your objection or revocation of your consent, provided that the marketing measure is based on your consent.

What happens when using this website for information purposes only?

We treat your personal data confidentially and in accordance with the legal data protection regulations as well as this data protection declaration.

If you use our website for information purposes only, i.e. if you neither register as a user nor provide us with information in any other way, we collect the following data from you: IP address, date and time of the request, time zone difference to Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, amount of data transmitted in each case, website from which the request comes, browser, operating system and its interface, language and version of the browser software. We reserve the right to check this data subsequently if we become aware of any concrete indications of illegal use. We receive this data via cookies and directly from your browser. The purpose of this processing is the provision of our website as well as the statistical evaluation. The legal basis for this is Article 6(1), par. 1, sent. 1 f GDPR, according to which the processing of personal data is also possible without the consent of the data subject if the processing is necessary to safeguard the legitimate interests of the data controller or a third party, unless the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data, prevail.

Are we obliged to collect this data? What happens if we do not collect this information?

There is no legal obligation to collect this data. However, it is possible that it will be more difficult to visit our website if the survey is not carried out.

What rights do you have in connection with personal data?
